I recently reviewed 450 High Court decisions on SCC appeals, uncovering key trends that could help you understand what to expect. Let’s break down the insights.

Appeals Are Increasing, But Are They Succeeding?

The number of reported SCC appeals has grown significantly over the past three years. However, appealing isn’t just about filing paperwork—it’s about winning the case. And the data suggests that SCC appeals face an uphill battle.

More than half of SCC appeals (52%) were dismissed, meaning the High Court found no reason to overturn the original decision. In contrast, appeals from magistrates’ courts had a lower dismissal rate of 45.7%. This suggests that SCC appeals may be more complex to win compared to other types of appeals.

Who Handles SCC Appeals Matters

Some judges hear more SCC appeals than others. Justices Magare and the late Justice Majanja handled over a quarter of all SCC appeals, with Magare working across three different courts while Majanja was based at Milimani.

Interestingly, Justice Magare dismissed more appeals than the overall average, while Justice Majanja’s dismissal rate aligned with the general SCC appeal trend. This shows that the judge handling your appeal can influence the outcome.
