Duties of a Driver After a Road Accident

Under section 73 of the Traffic Act (Cap 403), a driver involved in a road accident causing injury or damage to a person, vehicle, dog or cattle must stop and, when reasonably required, provide their name and address, the owner’s details and the vehicle identification particulars. If the driver does not provide those details, or if injury is caused to a person, dog or cattle, the accident must be reported to a police station or police officer as soon as reasonably practicable and in any event within 24 hours. Failure to comply is an offence under section 75, punishable on a first conviction by a fine of up to KES 5,000 or imprisonment for up to three months. The court may also suspend, cancel or endorse a driving licence under section 76.
