Under the Law of Contract in Kenya (applying the classic rule in Hadley v Baxendale), when a contract is breached, the innocent party is entitled to damages that naturally arise from the breach or were within the contemplation of both parties. This includes loss of profit ("expectation loss"), provided the lost profits are not overly speculative and were a foreseeable result of the breach.
