The Midnight Subwoofer

The Environment and Land Court has held that a neighbour who plays loud music through the night may be restrained by an injunction until he complies with the applicable noise rules. The court also held that the fact that the noise is connected to worship does not excuse excessive noise.

In practice, the rule treats excessive noise as a matter of compliance with regulatory standards, whatever its purpose. An injunction operates as a temporary restraint, so the noise-maker is stopped until the noise rules are met. Religious character may be relevant to what is being done, but it does not displace the limits that apply to everyone.
